Divorce & Family Law

In the United States, divorce rates are on the rise and are affecting more than just the relationship of a married couple. It impacts couples and families emotionally and financially. In some cases, divorces are more costly than entering a marriage and can have both short-term and long-term impacts. Even finding the right family law and divorce lawyers for your situation can play a big role in you moving forward with separation and divorce.

Divorce & Family Law

However, navigating the legal side of separation and divorce in North Carolina doesn’t have to be a challenge in the Piedmont Triad North Carolina area nor finding an experienced divorce attorney in Greensboro NC. Once you have chosen the right Greensboro Divorce Attorney or attorney that services a community nearby to you, they can assist you on a wide variety of legal issues related to separation, divorce, equitable distribution, alimony, child custody and support, domestic violence, and much more. These divorce attorneys and family planning attorneys specialize in preparing you for each step of your separation and divorce and can even provide services related to family planning as related to children and other family members.

Once you decide that separation and divorce is the right choice for you, you need to know the basic steps of divorce. In the state of North Carolina, to obtain an Absolute Divorce, a couple must be separated for a year and a day. Separation includes for at least one spouse to have intent for separation to be permanent and to be living in a separate residence. When starting the separation process, a written separation agreement can be reached, which outlines a plan of separation. Though not required, separation agreements are one of the many ways to protect your property, assets and to ensure you and your family’s best interests are being met before filing final divorce documents.

Once the duration of the separation period has been reached, then can filing for divorce proceed. To proceed with filing for divorce, the following documents must be submitted to the Clerk of Court:

  1. Complaint – request for divorce and details/facts of the case and reason for divorce.
  2. Summons
  3. Domestic Civil Action Cover Sheet
  4. Affidavit Pursuant to the Servicemembers Civil Relief Act – disclosure of whether spouse is in the military or not.
  5. Filing Fee

After documents have been filed with the court, a copy must be served to your spouse. There will then be a divorce hearing in which your Absolute Divorce Order will be heard before a judge. At the hearing, you will testify to the facts regarding your divorce and will, in most cases, receive the divorce judgment upon completion of the divorce hearing. Once a divorce is finalized, both parties must uphold any agreements pertained to property, assets, alimony, and, if applicable, child support and custody. At the Law Office of Stephen E. Robertson, we provide all the mentioned divorce and family law services as listed above. Stephen E. Robertson is a Family Law Attorney in Greensboro NC as well as a very reputable Greensboro Divorce Lawyer. He serves the following North Carolina counties: Guilford, Rockingham, Randolph, Forsyth, Davidson, Alamance, and surrounding communities.
